Terms and Conditions

These Terms and Conditions together with the Community Helpings Coop Privacy Policy (collectively, the "Conditions") bind Community Helpings Coop and the CommunityHelpings.com website (collectively, "Coop") and its customer ("You") regarding the sale and purchase of goods ("Items"), and supersede all prior agreements. Any additional, inconsistent or different terms or conditions contained in Your purchase order or other documents presented by or on behalf of You at any time, whether before or after the date hereof, shall be deemed a material alteration and not a rejection of these terms and conditions, and are hereby expressly rejected by the Coop. These Conditions shall be deemed acceptable by You without any such additional, inconsistent or different terms and conditions.

Delivery Schedule and Location

You agree unconditionally to have your Items delivered to the destination indicated on your order. Based on your Coop group choice at checkout, the Coop provides You with order delivery date, location, and times for Your Items. The Coop reserves the right to reschedule the delivery date, location, and time upon prior notice to You.

Delivery and Risk of Loss

Unless otherwise agreed, all sales are FOB from the Coop's shipping point. Responsibility and risk of loss or damage transfers to You at the Coop group's delivery location. You acknowledge that all deliveries are considered unattended deliveries. The Coop is not responsible, and you agree not to hold the Coop or its volunteers responsible, for any damage, loss, or theft that occurs to an unattended delivery. You are responsible for ensuring that someone is present at the Coop delivery location at the specified time of delivery to pickup Your Items.

Order Pick Up, Procedure and Terms

Items must be picked up on the specified date and time. The Coop will select a volunteer coordinator for your delivery location. You agree to abide by all procedures as set forth by the coordinator. You agree all Items left at the designated delivery location at the end of the specified delivery time shall be considered abandoned by You.

Abandoned Items

You agree to have any and all of your abandoned Items donated, without refund or recourse, to a food pantry, needy family, or other organization at the sole discretion of the volunteer coordinator.

Refund Policy

You are buying into a co-op, a pooling of members money to purchase Items at a great price. Your money has been spent, no refunds will be issued if you fail to pick up on time.

Acceptance of Orders

All orders are subject to acceptance by the Coop. The Coop reserves the right to withdraw Items from sale and modify these Conditions without prior notice. In the event of a shortage of Items, the Coop reserves the right to allocate available Items among customers at its own discretion.

Prices and Payment

Prices listed are for the Items described for the current order period. Prices applicable are those in effect at the time of acceptance of the order. Items without prices, or with zero dollar prices, are considered invalid and not available for order. You agree to pay each order in full before delivery. No deliveries will be made without payment unless an arrangement has been made before delivery.

Privacy and Security

Your privacy is important to us at the Coop. We want to make you feel comfortable and secure shopping online with us. Our privacy policy explains the types of information we gather, how it is protected, what we do with it and how you can correct or change information. By shopping at CommunityHelpingsCoop.com, You are accepting the practices described in our Privacy Policy.

Your Passwords and Account Security

You agree and understand that you are responsible for maintaining the confidentially of passwords associated with your account. Accordingly, you agree that you will be solely responsible to the Coop for all activities that occur under your account.

Content

You understand that all information which you may have access to as part of, or through Your use of, the Coop are the sole responsibility of the person from which such content originated. You agree that you are solely responsible for any content that you create, transmit, or display while using the Coop and for the consequences of your actions (including any loss or damage which the Coop may suffer) by doing so.

Limitation of Liability and Disclaimer of Warranty

Your use of, and participation in the Coop, CommunityHelpingsCoop.com and the Internet is entirely at your own risk. The Coop, CommunityHelpingsCoop.com and contents are provided on an "AS IS", "AS AVAILABLE" basis. To the fullest extent permitted by law. The material on CommunityHelpingsCoop.com is provided for lawful purposes only. The Coop controls and operates CommunityHelpingsCoop.com from Missouri, USA and makes no representation that these materials are appropriate or available for use in other locations. If you use CommunityHelpingsCoop.com from other locations, you are responsible for compliance with applicable local laws.

Indemnification

You agree to defend, indemnify and hold the Coop and its volunteer coordinators harmless from any claims and expenses, including attorney's fees, arising in connection with a violation of these Conditions by you or through the use of our service and/or website.

The Coop may give notice to you of a change in these Conditions and any other matter by general posting on CommunityHelpingsCoop.com.
